These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Bridgewater Logistics LLC, operating the brand and website Everpathhomes ("Bridgewater Logistics LLC", "we", "us", or "our"), concerning your access to and use of the everpathhomes.com website as well as any related web applications, SMS communication channels, and services (collectively, the "Site"). By accessing the Site, you agree that you have read, understood, and agree to be bound by all of these Terms of Service.

2. Legal Compliance and RepresentationYou agree to comply with all local, state, national, and international laws and regulations when using our Services. You affirm that there is no active, existing, or pending written contract or agreement with any other party related to the sale of the subject property for which you are seeking our services.

3. Inspection ProcessThe inspection period commences the day following the full execution of the purchase and sale agreement ("PSA") by both parties. Both parties agree to maintain communication and allow access to the subject property for additional inspections if needed, continuing for the period specified in the PSA. All inspections will be conducted by third-party professionals. Bridgewater Logistics LLC reserves the right, up until closing, to access the property alongside a third-party inspector to assess the structural integrity and condition of the property. The seller agrees to continue reasonable maintenance to preserve the current condition of the property until closing.

4. SMS/Text Messaging Program Description and FrequencyBridgewater Logistics LLC offers a text messaging program to schedule phone calls, qualify or disqualify properties, and provide notifications, alerts, and general communication regarding property buying services. Bridgewater Logistics LLC does not use SMS to market products or services. Message frequency varies depending on the level of interaction with our team, individual conversations, and the status of the property inquiry.

5. Cost, Rates, and Carrier LiabilityBridgewater Logistics LLC does not charge a fee for the SMS program. Standard text messaging and data rates may apply depending on your mobile carrier and plan. Mobile carriers (e.g., AT&T, T-Mobile, Verizon) are not liable for delayed or undelivered messages.

6. Opt-Out, Cancellation, and SupportParticipation in the SMS service can be canceled at any time. To stop receiving SMS messages, reply "STOP" or "QUIT" to any text message. Upon sending "STOP," a final message will be sent confirming the unsubscription, after which no further SMS messages will be sent. To rejoin the program, sign up through the website. For issues with the messaging program or for assistance, reply "HELP" to any message or utilize the Contact Us section on the website.

7. Privacy and Data ProtectionNo mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. If legal, tax, or other professional assistance is required, including for the review of agreements or forms made available through the services, you must seek independent, qualified professional advice.

9. Limitation of LiabilityBridgewater Logistics LLC, its officers, directors, employees, affiliates, agents, and licensors are not liable to you or any third party for any damages, including, but not limited to, direct, indirect, incidental, punitive, or consequential damages, arising out of or related to the use or attempted use of our services or any content provided therein. This includes claims or damages resulting from in-person assessments conducted by personnel, except to the extent such damage is directly caused by gross negligence or willful misconduct. This limitation of liability extends to any claims arising from system failures, inaccuracies, unforeseen national health interruptions, computer viruses, or national weather emergencies that may suspend or delay offered services.

10. Bridgewater Logistics LLC reserves the right to refuse to work with any individual or entity at any time, at its sole discretion.

11. Modifications to TermsBridgewater Logistics LLC reserves the right to modify these Terms of Service at any time. Revisions will be posted at this location. Continued use of the services or SMS program after changes are posted constitutes acceptance of the modified Terms.
